EVERY worker in Australia listen: your boss is NOT a wanker. Or if he is, do not put it on Facebook, Twitter or anything digital.

If you really hate your boss, consider making a voodoo doll you can needle at will, bagging them to your close friends and family, or using a picture of them in your cat's kitty litter tray.

A recent court decision has left no doubt that what you do on social media can be controlled by your boss — whether you are at work or on the couch.

Former Linfox employee Malcolm Person learned the social media lesson the hard way.

He lost his appeal in the Fair Work Commission on March 14 after being sacked by the trucking giant for what he said was his right to "freedom of speech."

The company's social media policy limited what he could say about his employer online — whether he was in uniform or his pyjamas, at the pub or in the warehouse.

The company also said he breached the mobile phone policy because he was repeatedly sending text messages while on duty.

He said he needed his phone because he has elderly relatives in frail health and "I simply keep it on for emergencies".

About the social media, Mr Pearson said: "Linfox do not pay me or control my life outside of my working hours, they cannot tell me what to do or say outside of work".

The court disagreed, saying that "gone is the time (if it ever existed) where an employee might claim posts on social media are intended to be for private consumption only".

The court also found he failed to make formal arrangements with Linfox to check his phone for emergencies.

As a result, Mr Pearson lost his unfair dismissal claim and is now out of a job with the company.

Some people might think the right to call your boss a "wanker" should be written into the Constitution, or that social media is somehow private — but they are probably unemployed.

Indeed there are many bosses who are thoroughbred wankers — my career in hospitality was full of them — but the key is not to tell them they're a wanker until the day you are leaving to go and work in an unrelated industry.

All this raises an important point: if you are going to bag your boss and still need to bring home the bacon, do not do it via your smartphone, tablet or home computer. The internet is forever.

Workplace lawyer and executive consultant Grant Archer said bagging your boss on social media is "permanent and spreads."

"The court is saying that it is pretty naive to think you've got some sort of invisibility shield to say what you like when you are not in the traditional bricks and mortar workplace," he said.

"What they are saying is that putting it on Facebook is akin to standing up in the middle of a crowded pub and screaming out 'my boss is a wanker'."
